Photography Services Agreement

1. Booking & Session Details

This Agreement is entered into between Cabrini Studios ("Studio") and the client named below ("Client") for the photography services described in this document.

2. Investment & Payment Schedule

A non-refundable retainer of twenty-five percent (25%) of the total package price is due to confirm and reserve the Session date. The remaining balance is due no later than fourteen (14) days prior to the Session, calculated automatically below.

Late payments not received within five (5) business days of the due date may incur a late fee and may result in suspension of Services, as further described in the Studio's Terms & Conditions.

3. Cancellation & Rescheduling Policy

The retainer identified above is non-refundable under all circumstances, as it compensates the Studio for reserving the Session date and declining other engagements. Client-initiated cancellations received more than ninety (90) days before the Session are entitled to a refund of any payments made beyond the retainer; cancellations received between ninety (90) and thirty (30) days before the Session are entitled to a fifty percent (50%) refund of payments made beyond the retainer; and cancellations received less than thirty (30) days before the Session are non-refundable in full.

The Studio will accommodate one date change at no additional fee if requested more than sixty (60) days in advance, subject to availability. Date changes requested inside sixty (60) days, or subsequent changes, may incur a rescheduling fee of up to fifteen percent (15%) of the total package price.

In the rare event the Studio is unable to perform due to illness, emergency, or other circumstances beyond reasonable control, the Studio will use commercially reasonable efforts to secure a qualified substitute photographer of comparable skill and style; if none is available or acceptable to the Client, the Studio will refund all amounts paid, which shall be the Client's sole and exclusive remedy.

4. Image & Video Usage Rights

The Studio retains full copyright ownership of all photographs and, where applicable, video recordings ("Images") captured during the Session. Upon receipt of full payment, the Client is granted a personal, non-exclusive, non-transferable, royalty-free license to reproduce, print, and share the final, edited Images for personal, non-commercial purposes, including social media, provided that public use includes photographer credit ("Cabrini Studios") where reasonably practicable.

For product and commercial engagements, the scope, duration, territory, and exclusivity of the Client's usage license shall be as separately set out in the applicable commercial license agreement or invoice.

The Studio retains the right to use Images from this Session for its own portfolio, website, social media, marketing, editorial submissions, and competition entries, unless the Client checks the opt-out box below.

5. Model Release

By signing this Agreement, the Client, on behalf of themselves and all individuals appearing in the Images captured during the Session (including guests, wedding party members, employees, models, and minors under the Client's care, for whom the Client represents they have obtained parental or guardian consent), grants Cabrini Studios the irrevocable right to photograph and/or film such individuals and to use, reproduce, and publish the resulting Images as described in the Image & Video Usage Rights section above, without further compensation, unless the opt-out box above has been checked. The Client represents and warrants that they have the authority to grant this release on behalf of all individuals present at the Session to the extent required by law.

6. General Terms

This Agreement incorporates by reference the Studio's complete Terms & Conditions, which further address fees, delivery timelines, liability, insurance, travel, force majeure, dispute resolution, and governing law (State of Illinois). In the event of any conflict between this Agreement and the Terms & Conditions with respect to the Session described herein, this signed Agreement shall govern.

7. Signatures

By typing your name below and submitting this form, you acknowledge that you have read, understood, and agree to be bound by this Agreement in its entirety, including the Cancellation & Rescheduling Policy, Image & Video Usage Rights, Model Release above, and the Studio's full Terms & Conditions.
